Scalia specifically states that the AR-15 rifle is protected by the 2nd Amendment in his dissent in Friedman v Highland Park which came after Heller. He dissented from the majority who refused to hear the case….he stated that they should have taken the case and that Highland Park and the judge who ruled for them was wrong….and then goes on to state the AR-15 meets the “Common Use” protection……..
